Who is obliged to pay Non-Resident Tax in Spain?
It is payable by individuals or companies that earn income in Spain but are not tax resident in the country. This includes owners of real estate in Spain, workers with income in Spanish territory and foreign companies with economic activity in Spain.
What happens if I do not file the Non-Resident Tax?
Failure to file the tax can lead to penalties, surcharges and late payment interest from the Tax Agency. In addition, if you own a property in Spain, the Inland Revenue may detect non-payment and claim the outstanding amounts, increasing the debt with penalties.
When and how do I file form 210 for Non-Resident Tax?
Form 210 is filed quarterly if the property is rented or once a year if it does not generate income. It can be filed online at the Tax Agency or through an authorised agent.
